Organizer Terms of Service

These Organizer Terms of Service ("Organizer Terms") apply to individuals or entities ("Organizers," "you") who create, publish, or manage events on the DawgPark platform ("Platform," "we," "us," "our").
By creating, publishing, or managing an event, you agree to these Organizer Terms.
1. Relationship Between Organizer and Platform
1.1 Independent Organizer
You understand and agree that you are an independent event operator. We do not organize, host, supervise, or control your events.
1.2 No Partnership or Joint Venture
Nothing in these Organizer Terms creates a partnership, joint venture, employment relationship, or agency between you and us.
2. Organizer Responsibilities
2.1 Event Operations
You are solely responsible for all aspects of your events, including:
- Planning, hosting, and supervising activities
- Ensuring participant safety
- Staffing, equipment, and facilities
- Rules, format, scoring, brackets, and results
- Communications with participants
2.2 Safety, Waivers, and Risk Management
You are responsible for:
- Assessing safety risks
- Ensuring facilities and equipment meet standards
- Providing and enforcing participant liability waivers (if required)
- Obtaining all necessary insurance coverage
Participants' agreements to your waivers are between you and the participant, not with us.
2.3 Compliance With Laws
You must comply with all applicable laws, venue rules, sanctioning-body requirements, and permit obligations.
2.4 Event Accuracy
All information you publish must be accurate and kept up to date (schedules, locations, rules, prices, format, etc.).
3. Payments, Refunds, and Fees
3.1 Payment Processing
Payments on the Platform may be processed by third-party providers (e.g., Stripe). You agree to comply with their terms and onboarding requirements.
3.2 Payouts
Your eligibility to receive payouts requires completion of the Platform's payout onboarding process and compliance with all associated agreements (e.g., Payout Agreement).
3.3 Refunds and Disputes
You are solely responsible for:
- Setting your refund policy
- Communicating that policy clearly
- Processing refunds when required
- Resolving participant disputes
We may, but are not obligated to, facilitate communication between you and participants.
3.4 Chargebacks
You are responsible for any chargebacks or payment disputes related to your events. We may withhold or recover funds from future payouts to cover chargebacks, disputes, or suspected fraud.
3.5 Platform Fees
You agree to any service fees disclosed within the Platform, which may be deducted from participant payments or organizer payouts.
4. Content, Data, and Communications
4.1 Content You Provide
Event descriptions, images, rules, and other content you upload remain yours, but you grant us a license to store and display them as needed to operate the Platform.
4.2 Participant Information
You may receive access to participant information solely for the purpose of operating your event. You agree to handle this information securely and comply with all applicable privacy laws.
4.3 Communications
You agree not to misuse participant information or send spam, harassment, or unrelated communications.
5. Prohibited Conduct
You may not:
- Host unsafe or fraudulent events
- Misrepresent event information
- Circumvent the Platform's payment systems
- Engage in unfair, abusive, or discriminatory practices
- Upload unlawful or infringing content
We may suspend or remove events or organizer accounts that violate these terms.
6. Platform Role and Disclaimers
6.1 Technology Platform Only
We provide tools to help you manage events. We do not:
- Supervise your event operations
- Verify safety, facilities, or staff
- Screen participants
- Ensure rule compliance
- Provide insurance
- Handle refunds on your behalf
6.2 No Guarantee of Participation
We do not guarantee registration numbers, participant behavior, facility availability, or event success.
6.3 Platform Availability
"as is" without warranties of uninterrupted or error-free operation.
7. Indemnification
You agree to indemnify, defend, and hold harmless the Platform and its officers, employees, and affiliates from any claims, damages, liabilities, losses, or expenses arising out of:
- Your events
- Your waivers or failure to obtain waivers
- Your communications or conduct
- Your refund or payment practices
- Your violation of laws or these Organizer Terms
8. Limitation of Liability
To the maximum extent permitted by law, our liability to you for any claim relating to these Organizer Terms or your use of the Platform is limited to the fees paid by you to us in the twelve (12) months preceding the claim.
We are not liable for event injuries, property damage, participant disputes, venue issues, or financial losses arising from your event operations.
9. Termination
We may suspend or terminate your organizer privileges at any time for violations of these terms or if necessary to protect users or the Platform.
You may stop using the Platform at any time, but obligations relating to refunds, disputes, indemnification, and payments survive termination.
10. Modifications to Organizer Terms
We may update these Organizer Terms periodically. If changes are material, we will notify you and may require renewed acceptance before you can publish additional events.
11. Governing Law
These Organizer Terms are governed by the laws of the United States, excluding conflict-of-law rules.
